Local History Reproduction Policy

The Yorba Linda Public Library arranges for the reproduction of materials from the Yorba Linda Public Library Local History Collection. Reproduction of items in the collection is performed at the patron’s expense. Any further reproduction is prohibited without the written permission of the Yorba Linda Public Library.

COPYRIGHT

The Yorba Linda Public Library does not hold the copyright to all materials in the Local History Collection. It is the responsibility of the user to obtain any necessary permission.

Copyright protects the rights of creators of original works, including photographers, artists, architects, publishers, singers, writers and composers. Types of works covered include (but are not limited to) drawings, paintings, photographs, maps, blueprints, music and lyrics, literary writings of all kinds, choreographic works, audiovisual works, and all types of sound recordings. For these works, the copyright holder has the exclusive right to reproduce the work, prepare derivative works, distribute and/or sell copies of the original work, and perform or display the work publicly. Copyright law provides protection to unpublished as well as published materials.

The copyright law of the United States (Title 17, U.S. Code) governs the making of photocopies or other reproductions of copyrighted material. Under certain conditions specified in the law, libraries and archives are authorized to furnish photocopies or other reproductions of copyrighted works. One of these specified conditions is that the photocopy or reproduction is not to be "used for any purpose other than private study, scholarship, or research." If a user makes a request for, or later uses, a photocopy or reproduction for purposes in excess of "fair use," the user may be liable for copyright infringement. This institution reserves the right to refuse to accept a copying order if, in its judgment, fulfillment of the order would involve violation of the copyright law. The granting of permission to publish by the library does not absolve users of materials from securing permission from copyright owners and payment of such additional fees as the owners may require if the library does not own copyright or if the material is not in the public domain. Applicants assume all responsibility for questions of copyright and invasion of privacy that may arise in copying and in the use made of the photographic copy.

CREDIT INFORMATION

Reproductions from the Local History Collection must be credited with the standard credit line: Courtesy of the Yorba Linda Public Library. Materials reproduced for research may not later be used for publications or other public uses without written permission from the Yorba Linda Public Library. A completed copy of any publication using reproduced materials must be given, without charge, to the Library for its collection.

REPRODUCTION REQUESTS

In authorizing the reproduction of works within its collection, the Yorba Linda Public Library does not surrender its own right to publish or grant permission to others to do so. Reproduction of the copy prints received is not allowed, including any facsimile (including scanned copies).
